Anyway, where does the line go between clone and based upon?

Based upon attempts to use the same atmosphere+storyline+theme.
Clone is the exact same game with different graphics. :s

Well, I don't know if it's that simple. Have there ever been clones which don't modify the formula a bit? I want to exclude commercial clones from this question.

Citing Spike, "clone is the exact same game with little thing different, usually due technical or skill constraints" :P
I know FrikaC made a cgi-bin version of the quakec interpreter once and wrote part of his website in QuakeC :) (LordHavoc)

If you guy's haven't noticed, there is already another CoD homebrew game, but it's dead.
I took over the title and this mod will now be named Call Of Quake.
